A 22-year-old Bronx mother of two claims she was stuck with the tip of a syringe needle after biting into a Burger King sausage-and-egg sandwich in June – and she plans to sue for $9 million.
“I took a bite and then a second when I felt something inside my cheek. I started bleeding,” said Angelina Cruz.
Speaking at her lawyer’s office in Brooklyn, Cruz said she wrapped the needle tip in a tissue and showed it to the restaurant manager at the Astoria Boulevard franchise in Queens.
Cruz said she then went to the police and the emergency room.
Since the June 18 incident, Cruz says she has been traumatized by the fear that she may have contracted a deadly infectious disease. She said she is too afraid to get tested and has refrained from having relations with her fiancé – or even kissing her children, said her lawyer, David Seidemann.
“She doesn’t know what is worse, testing positive on an HIV test or the possible consequences,” said Seidemann. “It’s living with the fear of the unknown.”
Burger King said the company had heard nothing of the incident until yesterday.
“We are deeply troubled by allegations such as these,” said spokeswoman Kim Miller. “Since we have not seen the suit, nor were we contacted prior to today’s press conference, we cannot comment.”
Seidemann said the lawsuit will be filed Monday. He said he wrote Burger King but has not received a response.
Cruz is the second person this week to claim she was stuck by a needle when eating fast food. A Manhattan woman said she was pricked with a 21/2-inch needle when eating a McDonald’s hamburger at the Macy’s Herald Square restaurant.
